Special Board of Supervisors Meeting

Minutes

Chairman Jeff Karbash called the meeting to order at 1:00pm at the Town Hall.  Present: Karbash, Supervisors Dave Overbeek and Tom Kraus.

The group proceeded to the Buol property at Territorial and Lake Lorraine Roads to view the sites for proposed culvert installations to alleviate flooding in the area.  After viewing the site with Mr. Warren Buol, Board members returned to the Town Hall, where Supervisors Susan Miller and Carol Behrens joined the meeting, with Clerk Barb Ceas.

After Karbash, Overbeek and Kraus reported on what they had learned, Kraus Moved that after Overbeek obtains a preliminary approval by the DNR, we would proceed with the process. Second by Overbeek, passed unanimously. If there is no preliminary approval we will not proceed.

Motion by Overbeek, that if the DNR gives preliminary approval, Chairman Karbash should contact our Attorney to draw up documents to secure the necessary easements on the Buol property, and when the documents have been approved by the Buols, we will proceed with the engineering study (not to exceed $18,700). Second by Behrens, passed unanimously.

Karbash added the following terms/items to be included in the easement agreement:

– Town to pay Buol’s attorney fees (not to exceed $        ? get estimate from Town Attorney)

– Town to pay the next two (2) years of Buol’s property taxes

– Mr. Buol is concerned that if there is still flooding after the project is complete, the

Town will return the land to what it was before

– Town will have the Farm Service Agency review any problems with the crop fields

– Town will ensure no runoff or contamination to farm crops planted by Mr. Buol’s tenant

– Town will pay the Buol’s tenant farmer for the cost of crops destroyed by the project

– If the Town finds the engineering study does not support the project, we will not proceed with the project or the above bullet points.

Karbash stated this will be on the May 19 Town Board agenda for updates and possible further discussion and decisions.

Motion to Adjourn by Kraus, Second by Overbeek, passed unanimously. Respectfully submitted,
